The County Attorney's office prosecutes criminal cases within the city and county of Butte Silver Bow. It serves as legal advisor to the governing bodies of local, State, and School Districts. The activities of the office include: prosecution of criminal cases in the City, Justice, District, and Juvenile Courts and represents the city and county on all criminal and civil appeals to the Montana Supreme Court and the Federal Courts.
The County Attorney must also issue legal opinion upon submission of an authoritative request. The office also handles certain victim abuse complaints and family violence. The County Attorney is an elected position.
The County Attorney's office is located in the Courthouse, 155 West Granite, Room 104.

We hope this schedule will avoid conflicts with counsel being in Court. If conflicts do arise, counsel should advise the Court. Civil youth matters are held on Wednesday mornings. Check with the Judge's secretary to avoid conflicts. Law and Motion is held on Fridays at 9:00 a.m.

The Clerk of the Court is required by law to keep the minutes of court proceedings; issue legal processes and notices; accept passport applications, and issue marriage licenses. The Clerk must attend all court hearings and record judgments, wills, court orders, decrees, and summons. The Clerk of the Court is an elected position. The Coroner's Office investigates deaths within the city and county which occur from "other than natural causes". The activities of this office include investigation of deaths involving foul play; conducting investigations with appropriate law enforcement agencies; arranging forensic autopsies as applicable; conducting inquests upon the instructions of the County Attorney or Attorney General; and impaneling juries and summoning witnesses at inquests.M

Justice Courts

The activities of the office are: civil jurisdiction action if the sum claimed does not exceed $7,000; concurrent jurisdiction with the District Court; small claims action for amounts not exceeding $3,000; jurisdiction over forcible entry, unlawful detainer and residential landlord-tenant disputes.
The office has criminal jurisdiction for misdemeanors not exceeding $500 or six months incarceration; Fish and Game statutes; concurrent jurisdiction with District Court for misdemeanors; examining and committing courts for preliminary hearings.
The Justice of the Peace is an elected position. The Justices hold court at the Courthouse, 155 West Granite, Room 314. Phone (406) 497-6390.
Public Administrator

This position administers the probate of estates for deceased persons with no heirs, successors, or relatives. This elected office receives no salary but is eligible to assess a fee against each estate probated. Public Administrator is an elected position. Youth Court
Chief Probation Officer: Glen Granger
The Probation Office was created as a result of the Youth Court Act. The office provides counseling and rehabilitation services at the direction of the District Court Judges. The office also performs administrative and other tasks for the District Court.

Chief Executive Paul Babb
The governments of the city of Butte and Silver Bow County combined in 1977. The government is lead by the Chief Executive, Paul Babb and a 12-member Council of Commissioners.
Our business hours are Monday through Friday, 8:00 a.m. through 5:00 p.m. MDT, with no noon closure. Business offices are closed for State and Federal holidays.
Essential Public Works Services, (water, sewer, and road maintenance) are available 24 hours, seven days a week.

The function of the Butte-Silver Bow Government is to serve the citizens of the city of Butte and Silver Bow County. Our government's goal is to improve and maintain governmental operations and conditions within the boundaries of Silver Bow County.
